Terms of Use

Acceptance of Terms

  1. All users and/or participants including, but not limited to, Creditors and Debt Collectors, irrespective of their nationality, gender, age, language, vernacular, creed, race or otherwise (collectively referred to as the "Users") of http://www.globaldebtlist.com (the "Site") are subject to the terms of use contained herein from paragraphs numbered 1 - 28 (the "Terms of Use" or "Agreement"). Jackson & Becker International Limited ("JBI") reserves the right to update and/or amend the Terms of Use at any time without notice to the Users. The most current version of the Terms of Use is set forth herein. Any Users who use the Site hereby acknowledge that they have read these Terms of Use and in addition hereby agree to be bound to such Terms of Use.
  2. For the purposes of these Terms of Use:
    1. "Debt" means an amount of money outstanding and owing;
    2. "Debtor" means a person, company or otherwise who owes a Debt;
    3. "Creditor" means a person, company or otherwise who is owed a Debt;
    4. "Content" means any information including, but not limited to, personally identifiable information, website addresses, numbers, software, programs, data, names, topics, messages, emails, text, files, Debt, images, photographs and/or bytes;
    5. "Debt Collector" means a person, company or otherwise seeking to collect a Debt for the benefit of the Creditor; and
    6. "Introduction Fee" shall have the meaning as set forth in paragraph 11 herein.
  3. All other Capitalized terms contained in these Terms of Use are to be given the meaning as defined herein.
  4. The Site is a forum and/or venue to enable Creditors to connect with Debt Collectors. JBI does not take any part in the sale of debt collection services or in the collection of debt other than by providing the Site as a venue.

Registration

  1. Creditors may register and/or post Debt on the Site for Free by completing the necessary steps including, but not limited to, providing personal identifiable information and an overview of the Debt. The identity of Creditors will be hidden and not shown on the Site. The identity of the Debtors will also be hidden and not shown on the Site. Standard information about the Debt will be displayed and visible on the Site to enable a Debt Collector to carry-out due diligence on the Debt ("Standard Information"). Standard Information may include details such as the amount of the Debt, whether the Debt is disputed, the age of the Debt and whether the Debt is urgent or not. Any Creditor who registers and/or posts Debt on the Site agrees for the Standard Information to be disclosed on the Site and further agrees that their email address and contact details can be supplied to Debt Collector(s) who have registered on the Site. Any Creditor who registers and/or submits a Debt on the Site warrants that they have the power and authority, whether direct or implied, to post such Debt on the Site and to enter into and perform its obligations pursuant to these Terms of Use.
  2. Debt Collectors may seek to recover Debt registered on the Site by completing the necessary steps including, but not limited to, providing their name and contact details. The identity of Debt Collectors will be hidden and not shown on the Site. Upon registering on the Site, a Debt Collector may then request JBI to release contact details of a Creditor. Upon the Introduction Fee being paid by the Debt Collector to JBI, JBI will then release the Creditors contact details to the Debt Collector. Any Debt Collector who registers and/or contacts JBI for the release of Creditors' contact details, warrants that they have the legal power and authority, whether direct or implied, to register on the Site and to recover Debt. Debt Collectors further warrant that they are legally authorized under law including, but not limited to, United Arab Emirates law to offer their debt collection services on the Site and to offer to collect Debt listed on the Site.
  3. Any acceptance including, but not limited to, the terms of acceptance, by a Creditor for a Debt Collector to collect a Debt is independent of this Site and JBI. JBI does not act as an agent for either a Creditor and/or Debt Collector and therefore JBI does not participate in any transaction concluded, not concluded, agreed, or not agreed by a Creditor and Debt Collector. Further, all Users agree unconditionally and without revocation that if any dispute arises between Users that such dispute is independent of the Site and/or JBI.
  4. JBI does not perform any due diligence or otherwise on any of the Users and/or the Content submitted to the Site by Users. Therefore, all Users should conduct their own due diligence on the validity of any Content submitted on the Site including, but not limited to, Debt, Creditor and/or Debt Collector. JBI gives no undertakings, representations or warranties in connection to any Debt registered and/or submitted on the Site including, but not limited to, the accuracy of any listed Debt, the legality of the Debt Collector and/or the ability of the Debt Collector to collect a Debt.

Usernames

  1. Any usernames and/or passwords provided by the Site and/or JBI are to be kept confidential (the "Username"). Users are responsible for all activities that occur through the use of their Username. JBI shall be entitled to rely on any communication received from a Username and believe it to be genuine and correct and to have been communicated by or on behalf of the User whose Username was used.
  2. All Users will immediately notify the Site and/or JBI if such User believes that its Username including password are no longer confidential so that the Site and/or JBI can cease relying on that Username and password.

Users Conduct

  1. Users agree to not use the Site for any purpose that is unlawful under any law and/or prohibited by these Terms of Use.
  2. The Site may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable Users to communicate with others. Users agree to use the Site only to post, submit, provide and receive Content that is proper. By way of example, and not as a limitation, Users agree that when using the Site Users will not:
    1. use the Site in connection with surveys, contests, pyramid schemes, chain letters, junk email, ponzi schemes, spamming or any duplicative or unsolicited Content (commercial or otherwise);
    2. defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
    3. publish, post, submit, provide, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful Content;
    4. upload, or otherwise make available, Content that is protected by intellectual property laws, including, but not limited to, copyright or trademark laws (or by rights of privacy or publicity) unless Users own or control the rights thereto or have received all necessary consent to do the same;
    5. use any Content that is made available through the Site in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party;
    6. upload Content that contain viruses, Trojan horses, worms, time bombs, cancel-bots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
    7. download any Content posted by other Users of the Site that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner;
    8. falsify or delete any copyright management Content, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other Content contained in a file that is uploaded;
    9. restrict or inhibit other Users from using and enjoying the Site;
    10. violate any code of conduct or other guidelines which may be applicable for the operation of the Site;
    11. harvest or otherwise collect Content about others including, but not limited to, e-mail addresses;
    12. violate any applicable laws or regulations;
    13. create a false identity for the purpose of misleading others; or
    14. use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of Users of the Site or usage Content or any portion thereof.

Monitoring

  1. JBI has no obligation to monitor the Site and/or the Content. However, JBI reserves the right to review the Content and to remove any Content, in whole or in part, from the Site in its sole discretion. JBI reserves the right to terminate Users access, in whole or in part, to the Site at any time, without notice, for any reason whatsoever.
  2. JBI reserves the right at all times to disclose any Content as JBI deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any Content, in whole or in part, in JBI's sole discretion.

Liability & Indemnity

  1. Users should always use caution when giving out any Content including, but not limited to, personally identifiable information about themselves or their children to the Site. JBI does not control or endorse the Content found in or posted to the Site and, therefore, JBI specifically disclaims any liability with regard to the Site and any actions resulting from the Users participation in both the Site and/or relying on the Content.
  2. Users acknowledge and agree that use of both the Site and Content is at their own risk. In consideration of the Users using the Site, Users agree to indemnify and hold harmless JBI, its directors, employees, consultants, shareholders and its affiliates, of all liabilities, costs, damages, consequential losses, legal fees or otherwise with regard to the Site resulting from the Users participation, or inability to participate, of both the Site and/or relying on the Content.
  3. Managers and hosts are not authorized JBI spokespersons, and their views do not necessarily reflect those of JBI.
  4. Content uploaded to the Site may be subject to posted limitations on usage, reproduction and/or dissemination; Users are responsible for adhering to such limitations if they download the Content.

Linked Websites

  1. The Site may display links that let Users leave the Site to a third party website or web address (the "Links"). The Links are not under the control of JBI and accordingly JBI is not responsible for the contents of Links, or any changes or updates to such Links. JBI is not responsible for webcasting or any other form of transmission received including, but not limited to, advertising received from any Links. JBI is providing the Links to the Users as a convenience, and the inclusion of any Links does not imply endorsement by JBI of the Links.

Content & Ownership

  1. JBI does not claim ownership of the Content provided by Users to the Site including, but not limited to, feedback and suggestions. However, by providing Content to the Site, Users are granting JBI and its affiliates in connection with the operation of their Internet businesses the license rights to: copy, distribute, transmit, reproduce, edit, translate and reformat such Content and for such monetary amount as decided in JBI's sole discretion. No compensation will be paid with respect to the use of Content provided by Users to the Site.

Proprietary Rights

  1. The Site is protected by copyright laws. Any copying or duplication of the Site or its Content to other services is strictly prohibited. Users may not copy, duplicate or sell any Content for commercial purposes.

Waiver

  1. The failure of JBI to seek redress for violation, or to insist on strict performance, of any covenant, paragraph or condition of these Terms of Use shall not prevent a subsequent act which would have constituted a violation from having the effect of an original violation.

Severability

  1. In case any provision or paragraph in these Terms of Use shall be deemed to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions hereof shall not in any way be affected or impaired hereby.

Headings

  1. The headings in these Terms of Use are inserted for convenience of reference only and shall not control the interpretation of these Terms of Use.

Gender

  1. As used herein, masculine pronouns shall include the feminine and neuter, neuter pronouns shall include the masculine and the feminine, and the singular shall be deemed to include the plural.

Governing Law

  1. These Terms of Use shall be construed in accordance with of the laws of British Territory, the British Virgin Islands.
